1. The “Sunset to Sunrise” Rule #
This is the most critical protection for women in India.
- The Law: Under Section 43 of the BNSS, no woman can be arrested after sunset (6 PM) and before sunrise (6 AM).
- The Exception: In extreme or extraordinary cases, an arrest can only happen if a Female Police Officer obtains prior written permission from a Judicial Magistrate (First Class). A regular police officer cannot make this decision on their own.
2. Presence of Female Officers #
- Arrest: A woman must only be arrested by a female police officer. A male officer is not allowed to touch a woman during an arrest unless it is absolutely necessary to prevent her escape or in violent circumstances.
- Interrogation: All questioning and interrogation of a woman must be done in the presence of a female officer.
- Escort: If a woman is being moved from a police station to a court or hospital, she must be accompanied by female personnel.
3. Body Search & Physical Dignity #
If the police need to conduct a physical search of a woman:
- Strict Privacy: The search must be conducted by another woman only.
- Decency: The law requires the search to be done with “strict regard to decency.” It cannot be done in public or in the presence of men.
- Medical Exam: Any medical examination of a female accused must be performed by, or under the supervision of, a female registered medical practitioner.
4. Safety in the Police Station #
- Separate Lock-ups: Women cannot be kept in the same lock-up as men. Every police station must have a separate, secure room for female detainees.
- Right to Inform: Like all citizens, a woman has the right to immediately inform a relative or friend of her arrest.
- Legal Aid: If a woman cannot afford a lawyer, she has a right to Free Legal Aid provided by the State from the moment of her arrest.
5. Situation Checklist: If Rights are Violated #
If a woman is being harassed or arrested at night without a Magistrate’s order:
- [ ] Ask for the Female Officer: Immediately demand the presence of a lady constable or officer.
- [ ] Request the Order: If it is after 6 PM, ask to see the written permission from the Judicial Magistrate.
- [ ] Call for Help: Dial 112 or the Women’s Helpline 1091.
- [ ] Identify the Station: Note the name and belt number of the officers involved.
- [ ] Statement to Magistrate: When produced in court (within 24 hours), the woman should immediately tell the Magistrate if she was touched by a male officer or arrested after sunset illegally.
6. The Official Proof (For Authority) #
Section 43 of the BNSS, 2023 (formerly Sec 46 CrPC): “Save in exceptional circumstances, no woman shall be arrested after sunset and before sunrise, and where such exceptional circumstances exist, the woman police officer shall… obtain the prior permission of the Judicial Magistrate.”
Sheela Barse v. State of Maharashtra: The Supreme Court laid down that it is the duty of the police to inform arrested women of their right to a lawyer and to ensure their safety from any form of abuse in custody.
