3. Situation Checklist: What to do right now #

  • [ ] Collect Evidence: Take photos and videos showing the smoke or dust spreading into residential areas. Note the date, time, and wind direction.
  • [ ] Check the “Consent”: Under the 2026 guidelines, every industry must display its Consent to Operate (CTO). If they don’t have it, they are illegal.

Construction is the #1 source of local dust. Builders MUST follow these Dust Mitigation Rules:

  1. Enclosure: The entire site must be covered with green wind-breaker nets.
  2. Water Sprinkling: Water must be sprayed regularly on loose soil and piles of sand.
  3. Covered Transport: Any truck carrying sand or bricks must be fully covered with a tarpaulin.
  4. No Grinding in Open: Stone crushing or tile cutting must happen in an enclosed area.

  • Registered Environment Auditors: In 2026, the government introduced “Registered Environment Auditors.” You can check if a nearby factory has been audited recently through the UCAMS Portal.
  • Public Nuisance: If smoke is entering your home, you can file an FIR under Section 268 of the IPC (Public Nuisance) at your local police station.
  • The “Polluter Pays” Principle: If air pollution causes you health issues (asthma, etc.), you can sue for compensation in the National Green Tribunal (NGT).

6. The Official Proof (For Authority) #

The Air (Prevention and Control of Pollution) Act, 1981:

“No person shall, without the previous consent of the State Board, establish or operate any industrial plant in an air pollution control area.”

Article 51A(g):
